As redevelopment of urban shantytowns is pushed forward and public awareness of property rights increases, more civil lawsuits arise from debates over the standards of compensation for houses that are built on state-owned land. It is difficult to process these lawsuits according to existent regulations, which only include broad concepts, but not enough details that can be used as guidance for practice. Hence, disputes emerge that are focused on several key issues:how to define public interests? What standard should we adopt to compensate for unregistered properties? How to treat the residential properties that are converted to commercial use? Debates also arise from how to distinguish commercial properties from residential properties and how to measure the size of involved properties.In my dissertation, I study a legal conflict between a citizen that is named Li Guangshun and the local government of Quanshang District, Xuzhou. In this lawsuit, the local government is accused for choosing an assets evaluation organization that miscalculates the size of reclaimed properties and delivers the report of evaluation in a disputable way. Based on my analysis, I attempt to answer following research questions:Does the compensation scheme decided by the local government fit the public interests? Does the local government choose the evaluation organization in a just and objective manner? Does the organization compose an evaluation report with unambiguous meanings and deliver it to the plaintiff in time? At the end, I also highlight the main concerns for defending the rights of property owners and propose some policy suggestions.
