Construction On Mortgage System Of Contracted Land Management Rights

Contracted land management rights is a new usufruct right, a new type of rural land property rights proposed by the state since the Third Plenary Session of the Eighteenth Central Committee, unlike "rural land contract management rights" of the current law, contracted land management rights, including land management rights obtained through household contract and land management rights obtained through legal circulation way. With the development of agricultural modernization, in order to promote agricultural moderate scale of production and revitalize the rural land resources, the pilot region raise money through settlement of mortgage of contracted land management rights, which increases capital investment of agricultural scale management. But, the mortgage system of contracted land management rights is still in the exploratory stage, contracted land management rights is still blank in the legal norms, and the relevant supporting mechanism is not perfect. Author analyzes the underlying nature of mortgage、type of mortgage、subject of mortgage relations、the establishment and registration of mortgage and realization of mortgage of contracted land management rights,and put forward sound recommendations on price assessment、 market turnover and loan risk compensation and control of contracted land management rights on the basis of the study of "Property Law", "Security Law", "Rural Land Contract Law" and the basic principles of real estate mortgage system.
