| In order to perfect the criminal regulation of terrorism activities, it’s necessary to improve the legal system of anti-terrorism continuously on the basis of strengthening anti-terrorism criminal law. The aim of this paper is to study the direction of legislation on terrorism crime in China comprehensively, based on anti-terrorism criminal legislation from the perspective of typed legislation. On the basis of classifying anti-terrorism criminal legislation modes and paths, the experience of anti-terrorism legislation all over the world has been summed up to explore a reasonable anti-terrorism criminal legislation mode for promoting the development of the legal system of anti-terrorism.The first part of this paper described the origin and status of anti-terrorism legislation in China. Before the "anti-terrorism laws" issued, the main anti-terrorism of China was criminal regulation. This paper analyzed the process of China’s anti-terrorism criminal legislation form the historical sight and described it with both international and domestic laws. Based on the previous step, this paper discussed the current anti-terrorism legislation, analyzed the characteristics and pointed out some existing problems. The second part:Expounded the typology theory and explained the connotations of typology. Compared the conceptual thinking and typology thinking. And researched the typology problems in anti-terrorism and concluded the legislative mode and legislative path. The third part studied the direction and content of the foreign anti-terrorism legislation. Got some references and revelations for China based on the result (including the legislative feature and experience).The forth part investigated the selection and improvement of the typology in Chinese anti-terrorism legislation, which is also the conclusion of this article. Through the above statement, summarized the anti-terrorism criminal legislation mode and path in China and put forward some Suggestions to the perfection of legislative contents. |
