Research On Legislative Regulation Of Cyber-terrorism Crime

Cyber-terrorism crime is the escalation of traditional terrorism crime.It refers to the act of terrorists relying on the network and attacking the network to complete terrorist attacks.The harm of cyber-terrorism crime is very serious.We must strengthen the punishment,and perfecting and strengthening the legislative regulation is an important link to prevent and punish cyber-terrorism crime.Therefore,this study has important academic value and practical significance.This research mainly uses literature analysis,comparative research and interdisciplinary research.The paper consists of four parts.The first part of the paper defines the concept of cyber-terrorism crime,analyses the constitution of cyber-terrorism crime,and explores the significance of legislative regulation of cyber-terrorism crime.The second part carries on the international investigation to the legislation of cyber-terrorism crime.Through combing and investigating the laws and regulations of the United States,Britain,Russia and other countries on combating cyber-terrorism crime and the international conventions on regulating cyber-terrorism crime,it is found that there are still blind spots in the definition of cyber-terrorism crime in the international community at present,as well as the laws and regulations on regulating such crimes.Serious deficiencies.The third part investigates the legislative status of cyber-terrorism crime in China and finds out the existing problems.The fourth part puts forward some suggestions on perfecting the legislation and regulation of cyber-terrorism crime.In the international perspective,we should attach importance to the role of international conventions,multilateral treaties and bilateral treaties,and strengthen cooperation and joint anti-terrorism among countries.From the domestic perspective,we should speed up the improvement of the legal system of anti-cyber-terrorism crimes,especially the establishment of a special chapter on "cyber-terrorism crimes" in the Anti-terrorism Law of China,and put cyber-terrorism crimes into prison,clarify the ways and means of punishment,give consideration to both procedural and substantive laws,so as to achieve a real legal basis for dealing with criminals,which is the fundamental governance.The rational choice of cyber-terrorism crime.
