The Research About Civil Litigation Economy In "Collection Of Virtuous And Brightness Verdicts By Famous Judges"

Before the Song Dynasty, the economic litigation among the masses was very rare in the historical date. To the Song Dynasties, it appears in a large number. "Collection of Virtuous and Brightness Verdicts by Famous Judges "a book which records a large number of litigation cases. This paper takes the economic dispute cases as the center, and analyzes the historical recordswith the perspective of economic history.The main body of the thesis consists of three chapters.The first chapter mainly introduces the basic information of "Collection of Virtuous and Brightness Verdicts by Famous Judges", emphasis on the description of the social background at that time, and makes a brief introduction of the legal, economic, cultural and other aspects in Song Dynasty. It helps giving a general understanding of the phenomenon that the litigation cases appear in a large numbers.The second chapter is a summary of the characteristic of the civil and economic lawsuit cases in the book, which consists of three parts:the cases mostly occurred in the developed areas along the river in the southeast; the cases are mainly about the dispute of lands and houses and the cases are having a temper of the times with economic color and patriarchal clan system. It helps giving an intuitive and comprehensive understanding of the civil and economic litigation case in Song Dynasty by summarizing the cases in the book.The third chapter describes the life of people at that time according to the civil and economic lawsuits in "Collection of Virtuous and Brightness Verdicts by Famous Judges". Based on the first two chapters, the third chapter tries to find out some clues from the back of the large number of civil economic cases, which shows the economic life of people in Song Dynasty at that time. All of these can be seen that the land is quite active in the market, and the relevant factors of capital, labor also became active after it. In the case of evidence trading has become increasingly active, to ensure the orderly conduct of people’s economic life and safeguard the rights and interests of the general industry people, therefore establishing related trade laws is extremely important, in which special introduction indicating contract system and evidence system. Just under the contract system and the establishment of the evidence system, the land deals became more standardized, and the evidence system has an important guarantee for the settlement of the various contradictions arising from the land transaction. Both economic analyses and discussion of legal norms, they directly or indirectly reproduce the economic life of the people in the Two Song Dynasties.
