Parking lots and garages in residential ownership issue has always been important issues in the system of condominium, but at present, the provisions were too general, principles in China’s Property law, it is not conducive to the practice of dispute resolution. In the rapid economic development, parking lots and garages are becoming a scarce resource, clear division of ownership of parking lots and garages is beneficial to protect the property rights of ordinary people, promote the use of objects and prevent disputes. Using extraterritorial legislation provisions on the ownership of residential parking lots and garage, analysis of vulnerabilities and defects of China’s current legal system while pointed out the difficulties of judicial practice brought by shortcomings of legislation, and put forward ideas or suggestions and analysis its reasonableness. Start from the identified issues, based on analyzing and solving problems, in order to improve the related system architecture of parking lots and garages belonging. The thesis consists of introduction, body and conclusion, the body is divided into four chapters.Preface introduces the present situation of the system of parking lots and garages, and significance of this research and innovation.Chapterl. "Overview theory the ownership of parking lots and garages in residential". This chapter starts from the legal basis of residential concept, type and ownership of the parking lots and garages.Chapter2. To discuss the underlying causes of disputes the ownership of parking lots and garages through induction of condominium ownership theory and China’s scholars argue.Chapter3. Extraterritorial legislative provisions and comparative analysis of property of parking lots and garages in residential. Analysis the different legislative models of the property right of parking lots and garages’ownership, and the advantages and disadvantages of different models. Chapter4. Legislation exploration and practical dilemma of Parking lots and garages in residential ownership in China.To clear the right way of judicial practice by analyzing legislative research and Legislative defects of the parking lots and garages’ ownership before and after the Property law’s implementation in some places.The legislative recommendations for perfecting the property of parking lots and garages in residential. Forward a clear concept of and garages, divided parking lots types and clear ownership from learning by Taiwan, Hong Kong’s model type to improve the registration system of real estate and propose concrete solutions to guide practice.
