The city serves as its carrier, the body of it is forest vegetation, and it takes urban afforestation, city beautification and urban ecology as its goals. Urban forestry is a people oriented welfare, which shoulders many important missions, such as combining forest landscape and cultural landscape, improving the urban ecological environment, speeding up the urban ecology process, promoting the harmonious coexistence of the city, the people and the nature environment, and promoting the sustainable development of the city itself. It is very meaningful that we consider the urban forestry legal system from the view of ecological civilization, which could not only pass the mainstream value of ecological civilization and comply with the concept that lucid waters and lush mountains are invaluable assets, but also provide guidelines for the legal construction of urban forestry and solve the problems of lack of planning legislation, law enforcement standers varies and local characteristics blur. Hence, the operability of urban forestry laws and regulations could be improved so that the practical role of urban forestry in construction of ecological civilization would be more effective.The government has, on the national and local levels, explored the construction of urban forestry legal system under different degree. From the national level,<Forest Law>,<City Green Ordinance>,<City Planning Law> and Environmental Law> are legislation that related to urban forestry. From the local levels, Beijing, Shanghai and Harbin also introduces the <Beijing Greening Compensation Payment>,<Shanghai Out Ring Greenbelt Management Approach> and <Belt Around the City of Harbin Management Approach>, which accumulates the experience of urban forestry legislation.However, there are still many problems to be solved in the process of urban forestry legislation. For example, at present, the customary of "practice prior, legislation later" is still employed in the construction of urban forestry legal system, which lacks the comprehensive predictive analysis of the trend of urban forestry development, and owes the legislation plan. On the practice of law enforcement system, the authority crosses through the construction department and forestry department, leading to low enforcement efficiency and repetition of law enforcement.Survey around the world, both the mode of the U.S. Forest Service, the policy of the urban green blet in the U.K. and the experience of citizen involved in agreement concluded greening in Japan would all be very meaningful to the improvement of urban forestry legal system for our administration, especially for the aspects of the development of the body, specification of limits and the participation of public.Integrating the legislation practice of our government and the experience overseas, the legislation idea of highlighting the environmental benefits of urban forestry should be definite. The mode that national forestry laws severs as guidance and local government adapts to their conditions should be determined. Also, large system reform should be implemented to fulfill the goal of unified management of forestry, gardening and urban management. Hence, the public participation should be encouraged.
