This paper, based on the analysis of overview of electronic commerce, introduces the concept of personal information rights from the perspective of consumers in e-commerce and explores the the causes of the status quo of infringement and the main forms it takes on by defining the personal information rights in e-commerce and analyzing the status quo of the said infringement. Then this paper will discuss the current state of legal protection of the personal information rights in e-commerce by studying the legislation mode and forms of legal protection of personal information in other parts of the world, especially that of USA and Europe. Furthermore this paper will make a comprehensive observation of the current state of the protection of personal information in China and then analyze the existing problems of the practices and legislation on the protection of personal information. By the end this paper will try t provide some insights on strengthening the protection of the personal information rights on the basis of comparisons of domestic situation and foreign practices and the study results.The main aim of this paper is to raise the social awareness and personal caution about the protection of the personal information rights of consumers in e-commerce, amplify the need to practice self-protection of personal information in e-commerce and in the same time ring a bell on the urgency of immediate legislation on the part of the state of the personal information rights of citizens, especially in the area of e-commerce, improve the legal construction and industrial self-discipline and look forward to a bettering legal system on the particular matter.
