With the rapid change of Internet, it promotes the quality every aspect of modern life and we have to rely on the Internet technology. The impact of the Internet entered the legal level, the content and scope of the traditional right of privacy in the Internet environment, with the development of the Internet is also growing. Some of the new features presented in the right of privacy on the Internet, the network privacy is easy to be infringed, especially the infringement of network service. Compared with other infringement of the network users, the network service provider more easy to violations of network privacy of network users. Therefore, in this paper, the main is research network service providers the privacy tort subject of tort.This article first through the network service provider’s definition, the characteristic and the content of the network privacy right the basic concept analysis, in order to understand the network service provider’s network privacy infringement to lay the foundation. And according to China’s existing on network infringement and privacy law, focusing on the network service provider network privacy tort behavior and responsibility were studied and combining with the domestic and foreign network privacy protection legal system, put forward the shortcomings of protecting right of privacy of network of our country insurance, and on this basis, put forward suggestions of how to perfect.The text of this paper is divided into three parts. In the first part, the related concepts were defined, the concept and the classification of the network service provider, our circles of different classification reference, I quite agree, Mr. Yang Lixin classification methods, and on this basis, were in detail; on the network right of privacy defined the author uses comparison method, carries on the comparison to the traditional right of privacy, it is concluded that the characteristics of the right to privacy of the network, and summarizes the content of the right to privacy of the network. In the second part, according to the analysis of the first part of the basic concepts, combined with the traditional tort theory, type and characteristics of infringement of privacy on the Internet service provider are analyzed. Based on thesecond part of the network privacy tort behavior analysis, the in the third part mainly on service network privacy tort liability were studied liability forms of the traditional theory and through the research on imputation principle, analysis of three types of network service providers violate the privacy of network users different responsibility bear case. The last part, the author of the first from the introduction of a foreign network infringement protection law, summed up the our country is worth using for reference, in the final analysis, China’s legislative status and problems, on this basis to make recommendations to improve the network privacy right protection in China.
