The study to the Mortgage loan of the management right to contractual land will be a great innovation in the rural financial reform experiment. It will make a great breakthrough for gradually solve the current rural farmers, cooperatives financing difficulties. Finally, it will activate the rural financing function, and make the adding fuel to the flames in shaking off poverty and becoming prosperous, the modernization of agricultural and the rural economy development. The current law of our country does not allow the contractual management rights to rural land as collateral to transfer, which limits the right of land contractual management as a right of right benefit. However, our country have proposed the contractual management rights to rural land can be as collateral for loans, the local government also introduced corresponding management measures to promote the implementation of the central policy, some of the rural, rural financial institutions began to try to start the mortgage load with contractual management right of the rural land. Through the analysis of the implementation mortgage of contractual management right to rural land of Honghe Prefecture, sum up and study the problems of existing mortgage loan of the land contractual management right, mainly shows that the mortgage right is difficult to achieve, mortgage assessment value is difficult to determine, loan risk is difficult to control, legal system imperfect and so on. In view of the existing problems, put forward the innovation research to the mortgage of land contractual management right, mainly to the existing law, especially the circulation of the land contractual management right need to amend and make modification and optimization of the transfer restrictions to the land contractual management right, and the mortgage registration system to the contractual management right of the rural land, formed a set of mechanisms to assessment of the value of the land contractual management right, eliminate the obstacles of the rural financial institutions, then realize the mortgage, optimize the land contractual management right and the mortgage loan matching system, including improving the rural social security system, risk compensation mechanism and other supporting systems.
