The mortgage financing system of land contracting right is a systematic project.,which involves the laws of the land property rights protection and mortgage risk control and so on various aspects,it must be a number of factors synthetically,in order to carry out,Problems at any stage will reduce their effectiveness,The system deals with the innovation of the rights system of the civil and commercial law,such as the "three rights separation",It also relates to the system and system innovation of economic law and social law,such as industrial policy law and social security law.As an important measure of rural financial innovation,the system construction on the mortgage and the financing of the farmland franchise by contract is very important.The first part is to resolve the concept of the mortgage and the financing of the farmland franchise by contract,analyze the characteristics of mortgage contract of rural land contract management right and give a brief introduction to the financial knowledge of the mortgage of the farmland franchise by contract;Using the historical empirical research,the second part is to systematically comb the regulations and related policies on the farmland franchise by contract,and sum up the basic principles and policy trends of the farmland franchise by contract.The third part summarizes the the mortgage and financing modes of the farmland franchise by contract.According to the differences of these modes,it can be divided into the farmers-to-banks mortgage and financing mode of the farmland franchise by contract and the project-pool mode,which is more in line with the classification of financial markets.The fourth part analyzes the status and the risks of the mortgage and the financing of the farmland franchise by contract.Generally speaking,the development about the mortgage and the financing of the farmland franchise by contract in China showed a thriving trend,but there still are some related dilemma,such as the irregular managing authorities,the complex lawsuit relationships and the value evaluation problems;Compared to Japan,Germany and American systems of the farmland mortgage,there are some commons on legal integrity,financial institutions andfunding sources by using comparative research methods.The fifth part is to put forward the corresponding countermeasures to the legal system construction of the mortgage and the financing of the farmland franchise by contract,which concludes four aspects,the Ecological construction of the circulation market on the mortgage and the financing of the farmland franchise by contract,the establishment of market-oriented land value evaluation mechanism,the insurance system,the legal right of rural land contract management and agricultural land "three rights to divide".
