Internet and crime binding makes it harmful consequences far greater than in the past. Internet defamation is also true.Network libel is a crime, it is the Internet as a tool for crime. In our country, the Network libel is not a separate charges, but still be convicted and punished for defamation. In essence, the network libel is same with tradition defamation,they are the behave which fabricating facts, destroy the reputation of others. However, the network libel has its particularity. First, based on the convenience and privacy of the network, network libel phenomenon intensified, the number of layers is not poor, it has been a serious threat to the reputation protection, network order, and even extends to the social order. Second, based on the new generation of information transfer mode network, Harmful levels of network libel is much higher than in the past, especially the spirit and reputation damage. However, the defamation of our criminal law still stuck in that era when it was born, not progress over time. It no longer meet the needs of regulatory network libel. Therefore, this article from the particularity of network libel, through analyzing four elements of defamation to explore present judicial practices problem, and the improvement of the corresponding advice is given.This paper altogether is divided into four parts, the first part introduces the concept of network libel and its particularity, and described domestic and foreign regulatory of network libel. The second part analyzes the structure, and its new applications for defamation in the network libel. The third part mainly combined with the uniqueness of network libel and the four elements the analysis shows that the problem of regulation network libel with traditional defamation. The fourth part gives the corresponding recommendations and improvement methods.
