After being rescued,abducted children who have uncertain social identity and guardianship can not be adopted successfully once they can not find their biological parents. Based on the issued legal document Notice on the Adoptions of Abducted Children Who Can not Find Their Biological Parents After Being Rescued, this paper theoretically conduct a systematic study on the adoptions of abducted children after being rescued. The paper can be divided into four parts. The first part defines the concept of abducted children and analyzes their legal features and status, helping to study the adoption issues more accurately. The second part studies the guardianship and identity of abducted children after being rescued. Thus, the prepositive procedure of adoption-identity cognizance procedure-is proposed. This part mentions three aspects:the necessity of identity cognizance, the specific process and its consequences. On the basis of the previous two, the third-part is the specific study on adoption issues. Introduced by a case, this paper compares the adoption of ordinary children with adoptions of abducted children after being resuced, and analyzes the theoretical and practical issues during abducted children-adoption in a systematic way. After discovering such issues, the fourth part proposes several concrete system construction including probationary placement period, court review system and supervision system in order to provide a guidance for the judicial practice of abducted children-adoption, hoping to promote the modification and perfection of China’s Adoption Law.
