Studies On Administrative Legislation Towards The Protection Of Personal Information

The term "personal information" refers to any and all personal information which can be distinguished or identified either directly or indirectly. It includes identifying symbols closely associated with a particular individual, physical characteristics, psychological characteristics and specific particular experiences, covering a very wide range of factors. At the national administrative things, administrative legislation is a very important means of administrative legislation herein, refers to the legislative administrative nature, with the administration of the relevant administrative laws and regulations, part of the executive branch law, the national authorities administrative law-making activities and publish the specifications, it can be said that the development activities are called administrative law administrative legislation.Currently, personal information in this country is subject to suffering from acts of improper collection, misuse, malicious use and alteration, which can have consequences resulting in the disruption of the peaceful lives of individual citizens, and even lead to the endangerment of life and occurrences of property safety incidents. In the law of our country, though already developed a number of terms and personal information, but the protection of personal information and related administrative law are few. Given the legal awareness of the protection of personal information rights continue to strengthen administrative legislation protection of personal information has become increasingly important. Currently, many countries (regions) in the world have to be special legislation to protect personal information, such as the EU, the US, Germany and China’s Hong Kong, Macao and Taiwan regions have standardized collection, processing and use of personal information in the form of legislation and has made a lot of mature experience. It is imperative for us to engage in the humble study of foreign legislative models, to improve and perfect our currently existing legal system, and to gradually establish an effective administrative legislation system for the protection of personal information appropriate to China’s specific national conditions. Must learn from overseas legislative model, improve our existing legal system, and gradually establish a set of line with China’s national conditions and effective system of administrative legal protection of personal information, the development of a single law to protect personal information is a priority.This paper begins with the basic concept of personal information, its particular features, types, categories and legal properties, then integrating these factors with the current status of administrative legislation of personal information protection in this nation. Proceeding from the problems and issues of this nation’s administrative legislative protection of personal information, these problems of administrative legislative protection of personal information and their root causes shall be analyzed, then combined with a discussion of the successful experiences of administrative legislation for the protection of personal information in the European Union, the United States, Germany and the Chinese Hong Kong, Chinese Macao and Chinese Taiwan regions, proposals and suggestions for administrative legislation to protect personal information in this country shall be raised, based on the fundamental principles of protective legislative systems, general legislative systems, legal systems, and other related factors. It is hoped that this paper will be able to make a minor contribution to the implementation of this country’s administrative legislation of personal information in the future.
