After 30 years’ reform and opening up, China’s economic development has attained superb effect. Using economic analysis of law to study an intense employer-employee relationship can help maintain social stability, thus the society can develop steadily. According to Bureau of Labour and Social Security of Guangzhou Municipality, over the past decade, there was a continuous upward trend of different kinds of disputes related to workers’ remuneration. Construction industry is one of the most serious centers that suffer from labor disputes. The situation of the exploitation of labor remuneration is that their pay cannot be received on time or with full-paid salary. Besides, there is no legalized statement implemented that could protect labors’ reasonable welfare. Moreover, its reason why the labor-employer relationship is corrupted is owing to the construction subcontracting system. The construction subcontractors exploit labor remuneration from level to level. Additionally, the way how labor remuneration is calculated has reversed labors’ obligations and rights, which made their salaries being exploited. Simultaneously, flaws exist in the labor remuneration protection law in China, while the legal awareness of labor with their salaries is low. These two factors make the interest of labor remuneration easily harmed. Taking a look in Hong Kong and Taiwan, they have a more effective system in protecting construction workers’ interests than China, which is a favorable reference for us to ameliorate relating regulations. Therefore, China should have law of reification on employee-employer relationship, so as to enhance existing labor and social security legal system, and strengthen the effectiveness of law enforcement regarding the violation of interests of labor remuneration. With all the ways, they could thus safeguard construction workers’ rights and sustain the stability and harmony of our society, as well as promote the favorable growth of the construction market in China.
