| The construction market has an increasing demand for workers,and the construction workers have an increasingly large group,which plays an irreplaceable role in social life.Due to the reform of the construction labor system and the transfer of rural labor,a large number of migrant workers enter the city for work.The characteristics of low threshold and high return in the construction industry have a high matching degree with the conditions and salary requirements of migrant workers themselves,so migrant workers become the main component of construction workers.They are both workers and farmers,and they deserve better.In the context of the comprehensive implementation of the rule of law,why did the construction workers not take public relief to safeguard their legitimate rights and interests,but use private relief? This has become the main point of this paper.This paper is divided into four chapters.The first chapter starts from the private relief action of migrant workers’ rights protection in the construction industry,observing their private relief behavior with the method of case study and field investigation,and showing their current situation and characteristics of private relief.The second chapter reveals the reasons for the private relief of migrant workers in the construction industry,mainly from the three aspects of the characteristics of the construction industry,the ineffectiveness of institutionalized relief and the problems of migrant workers in the construction industry,showing the entanglement and helplessness of migrant workers in the construction industry at the bottom of the interest chain,and from the construction industry and rural society two fields,Construction companies,labor companies,contractors,construction workers and other subjects set out to explain the reasons for their private relief;The third chapter focuses on the relief system of the protection of workers’ rights in Hong Kong and Taiwan,and draws lessons from it.The fourth chapter points out that the relief of rights should be institutionalized,the institutionalization of public relief is relatively mature,and the institutionalization of private relief is of great significance,so as to help migrant workers in the construction industry and more social subjects to realize the private relief of rights.It is mainly divided into two aspects to promote: on the one hand,adhere to the main status of public relief,private relief to public relief;On the other hand,establish thelegal status of private relief,provide multi-channel relief channels,make them have the legal basis,define the scope of relief and action boundaries,and ensure the institutionalization of private relief. |
