Privilege of Silence is an important content of the criminal judicial system of moder n country under the rule of law, a period of time, about whether it should be given criminal suspects, the accused the Privilege of Silence in our criminal litigation, a ho t issues of common concern to become the field of procedural law and judicial pract ice department. The author thinks that in our country in the criminal procedure shoul d be gradually from the legislation on the establishment of the criminal suspect, the defendant has the right to silence. Through the origin of the right to silence criticism against China, the establishment of silence right view, and then discusses the necess ity of the establishment of the silence right system in our country, hopes to eventuall y improve China’s judicial system and the realization of judicial justice.
