As food safety attaches close contact to the public’s life as well as health, the issue of food safety is a major social problem commonly concerned by each state’s government. At present, the food safety problems are pretty highlighted in China, and relevant cases of lawbreaking and crimes frequently take place. However, the fact of incomplete legislation convergence, replacing punishment with imposing a fine, poor supervision of procurator organs, wind age of law executors, and so on, has hindered the effective convergence of criminal justice and administrative law enforcement of food safety cases, which suppresses the play of criminal law’s function of punishing crimes. This paper argues that complete policies are supposed to be established from the two levels of legislation and systems, serious lawbreaking and criminal behaviors of food safety ought to be beaten, so as to maintain and perfect food safety. Frequent cases of various types of food safety, have a great relationship with our current regulatory system mechanism, especially for administrative cases, the suspect handed over the criminal justice process convergence mechanism that is imperfect. This paper analyzes food law enforcement and criminal justice issues from three aspects. First, describes the two cases, summarizes the characteristics of cases of food safety and regulatory characteristics, analyze the reason why the interface between food cases of administrative law enforcement and criminal justice and leads to the problems of administrative law enforcement of food cases and criminal justice convergence. Second, this paper analysis of administrative enforcement of food cases of criminal justice problem of convergence from three aspects. The last will propose the suggestion of perfect convergence of food law enforcement and criminal justice.
