| Criminal Procedure of 2012 added a provision on covert investigative measures, but its covert investigation of the regulation are still some deficiencies. Legal supervision are only some principled legal provisions, which can not make the new Code of Criminal Procedure provide a workable system to protect covert investigation of legal supervision. In order to solve the problem of legal supervision means, right remedy mechanism and supervisory body, we must improve the legal supervision of the covert investigation mechanism. Since internal oversight and post-supervision of covert investigation is almost ineffective, and is difficult to achieve the purpose of protecting civil rights, so the legal supervision of the covert investigation need change from the internal oversight to the eternal supervision, from the post-supervision to the matter of supervision. Specific content of the legal supervision contain three aspects. The legal supervision of the covert investigation body should includes people’s court and legislature.Methods of supervision include improving the beforehand authorization, building the mechanism of the early intervention, building reporting system, establishing the sanctions regime and material system. Different measures should be provided with different content of supervision. |
