Research On The System Of Procuratorial Supervision Of Civil Execution

The newly revised civil procedure law of the People's Republic of China in 2012 opens a new historical period for procuratorial organs to supervise and supervise civil enforcement activities,which is an important milestone in the history of civil procuratorial supervision in china.China's civil enforcement procuratorial supervision system has been gradually established and improved from the bureau interview point to the full implementation,which is of great significance to solve the problem of confusion and enforcement and to better realize the substantive interests of the applicant.Judging from the present situation of the procuratorial supervision system of civil enforcement,there are still many institutional obstacles that affect the effectiveness of the implementation of supervision in judicial practice,such as the lag of supervision concept,divergence of supervision purpose,the unclear supervision scope,the ununified supervision method,the missing supervision procedure and so on,which needs the necessary theoretical concerns and realistic responses in the theoretical circle.I hope to solve these problems through theoretical research and constantly improve our civil enforcement procuratorial supervision system.In addition to the abstract and the introduction,this paper is divided into three parts.Part one: an overview of civil enforcement procuratorial supervision system in china.This part studies the historical evolution of China's civil enforcement procuratorial supervision system,the theoretical basis,the basic principles of the implementation of prosecutorial supervision,and the establishment of the problem and the necessity of carrying out procuratorial supervision system of civil enforcement in our country.Part two: This part based on judicial practice introduces the shortcomings of the system in reality and the reasons for its existence,it can provide a clear direction for the improvement of the system through the textual research on the reality.Part three: This part puts forward some concrete suggestions to perfect our civil enforcement supervision system,hope that the theoretical and practical circles can be supervised,and consensus is reached in the supervision and supervision procedures to further solve the existing problems in the operation.
