| This thesis focuses on the application of conflict rules concerning personality rights in China’s present legal system. For the structure of this thesis, the starting point is the analysis of rules, the content isguided by the questions raised upon and finally ended in multi-layers suggestions on the optimization of the present rules. At the beginning, this thesis defines the concept of ―personality rights‖ in the area of private international law, and comprehensivelyanalyzesChina’s current legal system in order to find the rules and principles behind. In addition, this thesis analyzes the current legal system from practical and theoretical point of views, to find the potential dilemma. After reaching complete understanding on the previous issues, based upon deep insight and analysis on reality, weighing objective advantages and disadvantages, this thesis raises several possible interpretive methods to resolve the potential dilemma. Finally, by referring tonumerous authorities, this thesis provides some suggestions for themodification of the current legal system in future. |
