An Empirical Study Of Pure Economic Loss

Pure economic loss is the loss of economic benefits contract law and tort law in question.Whether such losses economic interests should be protected by law, protected by law how and to what extent are protected, are closely related to the rights and interests protection systems in the different legal systems of contract law and tort law. Pure economic loss for us is not an unfamiliar topic in today’s highly market-oriented economy, it is more and more in front of us. Pure economic loss in disputed contract law is not, but also more by the tort law to regulate. The scope of compensation for pure economic loss has a knock-on effect of the uncertainty and it may also spread widely, how to control it for the compensation range is the most important issue we face.Combined with the reality of the infringement case to discuss the issue of compensation of pure economic loss, how to solve these problems for our country is also important, so I try from four parts to discuss the issue. The first part of pure economic loss elaborated on the concept of pure economic loss was discrimination, pure economic loss and analyze the characteristics and classification, while pure economic loss and direct economic losses indirect economic losses were compared. The second part of the observation of comparative law, EU frontier reference theory,the comparison is mainly France, the United Kingdom(mainly in England) and the German specification mode. French law represents a generalization protected open mode, the conservative mode represented the difference between German law to protect legal interests of English law adopted a practical model. The third part is to discuss on pure economic loss specification of the model and find our attitude towards the issue of compensation for pure economic loss. The fourth part is the focus of this study, to classify different types of pure economic loss compensation issues, the type of research, try to make different types of pure economic loss solution.
