Research On China Criminal Protection Of Environmental Rights And Interests

While the rapid development of the economy meets various demands and brings much convenience to humankind, it also brings about many problems, among which the environment problem has the widest involvement and greatest impact. The frequent occurrence of environment hazards around the world has seriously damaged the environmental rights and interests as well as aroused great attention on the protection of environmental rights and environmental problems. Due to the fact that there exist some problems in the traditional administrative law and civil law, they cannot implement effective management and control on the environmental crises which are becoming more and more violent. Thus the criminal law began to cause the attention of people and criminal protection of environmental rights and interests is gradually developing. The present paper first discusses environmental rights, environmental crime and other basic environmental problems and expounds the necessity of criminal protection of environmental rights and interests and the historical development and present situation of this issue. Then the author points out the defects and problems of the legislation idea, applicable principles of criminal law and specific rules of criminal protection of environmental rights and interests and also makes comparative studies of criminal protection of environmental rights and interests in foreign countries and regions. At last, the suggestions on how to perfect criminal protection of environmental rights and interests are put forward.
