Research On The Investment Legal System Of Tajikistan

Adjacent to Tajikistan and China, the two countries have a strong demand and desire to cooperate in the trade and investment field, the two countries continue to expand investment cooperation, especially the growing of China’s direct investment. Tajikistan’s economic has been growing in recent years, but still faces legal, political, cultural and other aspects of the problem, for investors, this is an opportunity as well as a challenge. In this paper, we study the basic problem of investment in Tajikistan. Using the method of literature analysis and comprehensive analysis to study the legal system of the investment of Tajikistan. And then analyzes the problems of China’s direct investment in the country and the conditions and advantages that can be used. So as to sum up the legal risks and countermeasures of China’s direct investment to Tajikistan.The first part of the article researches the investment legal system of Tajikistan on the basis of analysis of the market access system, the investment control system, the investment treatment system and the investment and investment dispute settlement system. In order to make clear the following four aspects : Firstly, the legal status that market access conditions in the country, the form of investment and investment subject in the country’s direct investment. Secondly, the country’s foreign management power, labor employment and management, tax management and foreign exchange management content. Thirdly, the legal protection nationalisation and expropriation and compensation, investment preferential policy of the investor’s investments of this country. Fourthly, the investment dispute settlement system of this country. This part is the introduction of the second part.The second part of the article analyzes mainly the problems existing in the direct investment to Tajikistan and usable conditions and advantage. This part analysis and explains Tajikistan’s problems, Chinese problems and problems existed in both them. It discusses mainly from legal risk, political risk, economic risk, and other aspects that could be faced in the China’s direct investment to Tajikistan. At the same time, it analyzes the usable conditions and advantages during the China’s direct investment to Tajikistan.The third part of the article puts forward the legal risk prevention countermeasures and suggestions in China’s direct investment to Tajikistan, according to the second part. This part mainly comes up some relevant suggestions from the perspective of the Chinese government and the Chinese enterprises. During the process of the China’s direct investment to Tajikistan, we need to pay attention to the legal risk prevention and political risk and economic risk prevention. And at the same time, we need to pay attention to other problems in the investment practices and make corresponding prevention countermeasures.
