Comparative Study On Foreign Investment Access System Of China And Tajikistan

China and Tajikistan belong to the same Asian countries,and their geographical location is close to each other.In recent years,investment cooperation between the two countries has been increasing,especially in Tajikistan,where China has a large investment flow.However,due to some drawbacks in Tajikistan’s foreign investment law,Chinese enterprises have some legal risks in the process of investing in Tajikistan,such as unclear provisions on the approval procedures in Tajikistan’s foreign investment access system,lack of detailed provisions on prohibition and restrictive measures,and imperfect foreign investment security review mechanism.Chinese and foreign investment law has obvious advantages in these aspects.On March 15,2019,China’s Draft Law on Foreign Investment by the Chinese People’s Communist Cooperation was approved by the 13 th National People’s Congress for the second time.The passed Foreign Investment Law replaced the "Three Capital Law" and integrated into a unified investment legal norm system,which further improved China’s foreign investment legislation system.However,compared with Tajikistan’s foreign investment law,China’s foreign investment law also has some drawbacks,such as too strict national security review,complex review procedures and numerous negative list items,which have brought certain restrictions on attracting foreign investment.From the perspective of legal theory,this paper analyses the legal provisions of the access system of Tajikistan and China’s foreign investment law,studies the background of the establishment of the foreign investment access system and the basis of the legal provisions of the two countries,and analyses the access system of Tajikistan and China’s foreign investment law from the rigid provisions of the legal provisions,and studies the foreign investment law of Tajikistan on the side of the access system.What are the problems of the two sides and put forward countermeasures and suggestions for further improvement of Tajikistan’s foreign investment access system under the background of "one belt and one road".
