Research On The Deficiencies And Perfection Of China’s Adult Self-determined Guardianship System

With the development of the human rights campaign after the second world war,more and more attention has been paid to the rights of the disabilities and the elderly.The adult self-determined guardianship becomes an important issue and the system of the self-determined guardianship finally has been established by the two law systems. There are still many problems in our adult guardianship system as the related law regulations are not complicated.The research object of this article is the self-determined guardianship.The author try to find out the problems of our casual guardianship system and give some suggestions.The content of this article besides the introduction, which is divided into four parts:The first part: the adult self-determined guardianship system by overview,as a theoretical foil, trying to explain the meaning of the adult self-determined guardianship system and differentiate between the similar concepts.The second part: foreign legal protection for the adult self-determined guardianship,inducing the legislative experience of the United States 、the British and the Japan.The third part: the present situation and problems of the adult self-determined guardianship system in our country,trying to find out the problems.The fourth part:the improvement of the adult self-determined guardianship system,trying to put forward some countermeasures and suggestions.
