The Method And Application Of Chinese Similar Patents Recognition Based On SAO

Nowadays, patent infringement disputes occur frequently. If companies involved in the infringement disputes, they will be faced with huge economic losses. Faced with patent infringement disputes, the most effective measure is that companies raise a patent invalidity request to Patent Reexamination Board of SIPO. The main evidences are that there were already similar patents before the filing date of the involved patent. Thus, this paper presents a method of Chinese similar patents recognition based on SAO. The significance of the paper is to help companies find some similar patents as invalidity evidences, so that companies can occupy a favorable position in patent infringement disputes.Claims is the core of the patent document.The scope of patent protection and judgment of patent infringement disputes also are based on claims. Therefore, the paper in-depth studies of the structural characteristics of Chinese patent claims.We present an identification method of Chinese similar patent to help companies to raise a patent invalidity request.The main contents include the following aspects.Firstly, we extract information from Chinese patent claims. In this section, claims are classified, divided into substrings and structured. And then, segmentation, POS tagging, syntactic analysis and semantic analysis are adopted.Secondly, we extract SAO structures from Chinese patent claims and calculate patent similarity. After extracting information, we extract SAO structures from claims of involved patents and related patents. And then, we calculate the similarity of SAO structures, obtain patent similarity based on SAO structures similarity, and convert to a dissimilarity matrix to perfrom multidimensional scaling(MDS). Based on the above steps, we judge the similarity between patents.Finally, we have an empirical analysis case. In order to verify the validity of method this paper proposed, we select a patent infringement litigation cases in the subway evacuation platform. Through the Chinese similar patents recognition method this paper proposed, we find the evidence patent that company put it as a patent invalidity request. More importantly, we also find other similar patents as invalidity evidence. Therefore, this empirical case demonstrates the effectiveness of method.
