On The Perfection Of China ’s Participation In The Distribution System

With the development of economy, the increase of economic disputes, more and more people into the court of the court of law. The phenomenon of the main debt has become very common, the legal person has the bankruptcy system protection, the natural person can only depend on the execution procedure to participate in the distribution system to realize own creditor’s rights. At present, from the point of view of judicial practice, the current judicial explain on the implementation of the provisions of the distribution system is very mechanical, there are many unsatisfactory aspects, so as to perform assigned work caused great distress. This paper tightly around the judicial practice, from many aspects to participate in the distribution system in judicial practice in accurate application, and combined with the practice, intends to establish a set of effective participation in distribution operation procedures, in order to improve the execution of the case quality and efficiency, and strive to achieve fairness and protect the lawful rights and interests of the creditors and other interested parties.This article is composed of four chapters, through the analysis of the definition of participation in the distribution system, the similarities and differences of domestic and international legislation and the status quo of our country, and so on. Then, from the perspective of legislation, we analyze the existing problems and the practical problems encountered in judicial practice. Finally, put forward some suggestions for the rationalization of the above problems, so that the current participation in the distribution system is more clear and smooth running.
