| Technical investigation activities are treated ‘the necessary evil’in the West, for it is easier to obtain evidence by technical investigation than ordinary police techniques in certain circumstance, whereas it easily infringes human rights. To regulate‘the necessary evil’strictly is the universal consensus nowadays,while there is no specific supervisory system in Chinese newly revised Criminal Procedure Law. Since ordinary monitoring methods cannot match the need of prevent individual rights from being invading by public authorities, as well as the technical investigation report can give policy makers and the public an overall view, which will results to a better monitoring of technical investigation activities, it is very urgent to establish the report system of technical investigations in China.Specifically, People’s Procuratorate could be the reporter of technical investigation, while People’s Congress would be the opposite side as the auditor. The technical investigation report which should be submitted to People’s Congress annually, would focus on practice and effect of technical investigation in the jurisdiction of the reporter. But if there were any sensitive information either relating to national security or confidences of technical investigation in the report, the reporter would eliminate these contents before submitting the report to People’s Congress. Only after being passed by People’s Congress could the technical investigation report be accessed to the public. |
