Study On Legal Issues Of Microfinance Supervision

China is a developing country, the speed of economic growth increase steadily, economy is optimistic, but because of China’s large population, small per capital economy, seriously lags behind other countries. At present, the "two one hundred" goal has not achieved, the development in both east and west is unbalanced, the gap between rich and poor is big, there are still 70.17 million poor people struggles to get rid of poverty. Poverty will make many unstable factors, lead to social unrest. All countries in the world are finding ways to rich. Microfinance as a kind of way of financial services, servicing the peasantry, the urban low-income groups, small micro enterprises, individual industrial and commercial households and other poor, is accepted by the countries all over the world and recognition. Our government concern for the microfinance particularly, because microfinance helps to accurately fulfill the policy of poverty alleviation. In the government’s strong support and encouragement, microcredit is developing rapidly, many institutions do business of microfinance in China. With the constant development of microfinance at the same time, its development has also exposed various problems in the process, especially the lack of supervision legal system, because of a lack of standardized guidelines, contribute to the development of microfinance and slow down the pace, and faced with the huge potential risks.Based on the above consideration, the author carried out some study. This paper revolved microfinance supervision legal system is divided into four parts to study. First introduced the relevant knowledge of small loans, making readers a preliminary understanding of microfinance,and microfinance regulation is introduced about the content, including the necessity of regulation,regulatory model, object of regulation. On basis of the basic knowledge to understand, through the analysis, the author discovered the problems that exist in the microfinance supervision in our country, and then study the microfinance supervision system in the United States and Bangladesh,summarizes the successful experience of their regulatory. Finally, combined with the actual situation of our country, draw lessons from foreign successful experience, puts forward the countermeasures of perfecting our country’s microfinance supervision legal system, the author hopes that through her research and analysis, to the sustainable healthy development of China’s small loans to provide theoretical basis and practical basis.
