Chinese Judge Supervision System Research

As the national judicial reform in full swing, People’s concept of the law will change inevitably. The judge as mediator in the judicial structure, solver of social disputes, the people’s rights defenders is very important. However, the judge as ordinary people, Enjoying great power at the same time, must also accept the supervision of the power given by the main body. Power is not easy to be controlled.The judge is going to make illegal behavior if he exercise of power. If the judge’s words and deeds have a loss to the people’s trust in his abuse of power,he will be punished. The supervision system is used for protecting the power, maintaining the judicial justice and preventing the judicial corruption. In recent years, a lot of judicial corruption case happened. the judge supervision is becoming more and more important. We should strengthen the judge qualifications, professional ethics, rewards and punishments, job security and supervision and so on various aspects of the specification for making better service to our society.This article is about the mainland and Taiwan area supervision system of the judge. First, we discuss the meaning of the judge, the connotation of supervision system, and the necessity of the supervision system of the judge. Secondly, we introduce the development of mainland China judges supervision system and the status quo, several main forms of supervision, and then put forward the lack of supervision system of the judge in China’s mainland. Third, we study the evolution of the judge supervision in Taiwan. Introduce the position of Taiwan district judge supervision and position in the court, the judge evaluation system, the judge self-discipline system. Finally, summarizes the judge supervision system in Taiwan and the mainland area of the advantages and disadvantages, thus judge supervision system in China’s mainland to set up specialized agencies, to fully security administration and other relevant measures.
