The Case Analysis Of Insider Trading And Divulging Inside Information Crime

But with the development of securities market, the change of The Times, more convenient communication tools and way to trade, criminals exposed implementation of insider trading,insider information behavior more hidden, evidence collection difficulty, the amount involved is huge, serious damage to the broad masses of investors, listed firms and national interests. Of the relevant laws and measures, regulations in our country gradually revealed its hysteresis, using the related regulations, examination and prosecution in the judicial practice this kind of crime, the new theoretical controversy. In this paper, by analyzing the " divulging inside information, who’s insider trading case", in the case of three controversial issues are analyzed. In this paper, the author divided into five parts:First of all, the author of " who’s insider trading case divulging inside information" were expounded, including the basic details of a case and review the court verdict, after this case involved in the dispute focus is put forward.Secondly, the author in the article the second, third and fourth part using the case study,normative analysis and comparative research method summarized suitable for dealing with insider trading in the judicial practice in our country, the theory of the crime of divulging inside information, and then USES these theories to analyze the case of the disputes, and put forward my own humble opinion.Finally, the author through the analysis of the case, put forward in the aspect of this crime law in our country at present existing defects and perfecting suggestion.
