Study On Sun Yat-sen’s Thought Of "Ruling By The Party" And Its Practice

As a leader of democratic revolution in China,Sun Yat-sen has always attached great importance to the role of political parties on the way of saving and governing the country.With the practical experience of revolution,Sun Yat-sen reached the thought of “Ruling by the Party”.This article is divided into five chapters.The first chapter,the formation of the Sun Yat-sen’s thought of “Ruling by the Party” has its profound historical background and the reality of the complicated reasons.And it has experienced a long process.Although the thought is greatly different from western Constitutional theory,its appearing has made huge contribution to KMT integrating social resources and leading the Chinese people to the victory of the national revolution.The second chapter,I analyzing the legislation practice of the Sun Yat-sen’s thought of“Ruling by the Party”.In the period of military,the legislation on government organization,labor union and labor worker reflected the absolute leadership of the KMT.But in the period of political tutelage,the legislation led to the Chiang Kai-shek’s personal dictatorship,and seriously distorterd the essence of Sun Yat-sen’s thought of “Ruling by the Party”.The third chapter,I analyzing the judicial practice of the Sun Yat-sen’s thought of “Ruling by the Party”.It was the inevitable choice of social environment that KMT had strengthened the control of judicial.But it seriously damaged the state authority restriction mechanism,and was not conducive to the establishment of the spirit of rule of law in China.From the judicial point of view,it severely damaged the building of the modern judicial system.The fourth chapter is to analyze the reality enlightenment of practical failure of the Sun Yat-sen’s thought of “Ruling by the Party”.This is the foothold of the paper.The Nanjing national government’s governance was seriously out of the intention of Sun Yat-sen’s thought of “Ruling by the Party”,and led to the appearance of a one-party state.Now I rethink the practical failure of the Sun Yat-sen’s thought of “Ruling by the Party” and hope to provide benefits for the party construction of the communist party of China.
