Pawnbroking is a engaged in to pledge or mortgage certain thing or rights, and lend special financial activities, the pawn industry in China is constantly play the financing, an emergency economic difficulties, with the deepening of economic system reform,pawnbroking began rapid development, but our country off to pawn industry legal system imperfect, pawn industry management confusion, is not conducive to the development of pawn industry.Pawn industry in the financial industry is a marginal industry, this is very easy to be ignored, not enough attention. Quite tortuous course of development of pawn industry, so the pawn industry in the initial stages of development appeared the phenomenon of out of control,higher interest violations; in such a development background, the state should strengthen supervision, especially now the Ministry of Commerce, the Provincial Department of commerce should be more detailed monitoring of its, should assume the functions of supervision. And the establishment of the legal system of supervision of the pawn industry is to regulate the behavior of the pawn industry, to better allow the pawn industry to flourish.Especially in recent years, the rapid development of the pawn industry, the number of pawn shops also increased year by year, but the rapid development and cited problems also presented. The current pawn industry regulation "effect level is low, it is difficult to stop the occurrence; regulatory philosophy is not clear, there is no a unified regulatory thinking; and"hock management measures "on access system and exit system is not perfect, resulting in operating activities of the pawn industry safety can not be guaranteed; and Pawn Industry Association of the regulatory role in hock line actual operation showed absolutely no it should play the role of, these are because caused by the pawn industry regulatory legal system is not perfect, so we must improve the supervision legal system of pawn industry as soon as possible,to make more perfect development of pawn industry.Through a comparative analysis of the content of the supervision legal system of the United States, Britain, Japan and China’s Hong Kong and Taiwan pawn industry, the author thinks that these countries (regions) regulation of pawnbroking industry of overseas legal systems is as sound as a bell, and China’s pawn industry regulatory system is not comprehensive enough, Ministry of Commerce and the provincial, municipal, county business department in charge of supervision system is not perfect, resulting in pawn industry to formal order of rapid development. Pawn industry business size is small, the business model is relatively simple, can not be a good mass service. Reference to the binding of pawn industryin China, the research status and existing problems, the domestic and foreign legal system, the author suggested to improve the supervision of the legal system of China’s pawn industry must be in the legislation, improve the industry access and exit system, the establishment of industry executives operation review; in pawn Industry Association, to highlight its role in the regulation of the legal system, promote the rapid development of the pawn industry; in the legal system, to improve the legal and regulatory system of China’s pawnbroking, to guide the industry better and more development.
