Analysis On Enterprise Dormantinvestor And Relevant Legal Issue

In recent years, the number of divorces in China is rising and the divorce rate is spiralling upwards, the breakdown of the family affects the physical and mental health of minors, which also caused the widespread concern in society, but the right to visit there children was often underplayed. Although the divorce is family member’s private affairs, but if this behavior has severely infringing the minor’s benefits, it should be governed with law. The visitation right used for the first time in the Marriage Law in 2001, the enforcement of the visiting rights and the termination of the visiting rights are still stipulated, so the parents and the children’s rights will be legally protected. Due to the nonstandard laws,the visitation system could not exert its system value in practice in our country. In order to solve the problems encountered in the judicial practice, we must find the root of these problems, learn from foreign experience, combined with China’s current situation, and offers the suggestion to perfect them, the basic idea of this paper is the case. This thesis is divided into five parts, I first introduce the definition of the visitation right, analyses its characteristics, nature, function, and as a logical starting point. The visitation right system in our country at present is not mature enough, but the system of visitation right in some developed countries such as the United States, Britain have been relatively improved, the author of the legislation through analyzing and studying in order to perfect the system of visitation right of our country. Therefore,the system of visitation right should consistent with national circumstances, so certain suggestions and countermeasures the problems,the author put forward for the system of visitation right based on the investigation results.
