Research On Legal Supervision Of Community Bank In Our Country

The “fake bank” incident which exposed by media in January 2015 revealed serious deficiencies in banking supervision law, and caused widespread concern in society.This paper studies community bank from the legal supervision perspective. Community Bank use its flexible and convenient operation model, provide targeted, diversified, personalized service for local residents,small and micro enterprises, can ease the financing difficulties of small and medium micro enterprises, refine banking market and fill financial services blank of some underdeveloped areas. However, community bank in China is still in its infancy development, under conditions of imperfect operation of legal regulation, there are single regulatory body, no specific regulatory approach, non-financial services regulatory gaps and other issues of community banks’ development. Therefore, it’s necessary to conduct in-depth study of theory and practice on legal supervision of community banks.This study is based on legal theory, with the review of domestic and international literature and analyze the status and problems of legal regulatory of community banks, then lays the logical starting point for this study. Use case studies and comparative analysis method to obtain enlightenment of American community banking regulatory system, and put forward some recommendations combined with China’s actual development of community bank. The study is divided into four chapters:First chapter starting from the basic theory of community banking supervision, we introduced the concept and law property of community bank, the distinction between community banks and related concepts and the special nature of community banks.The second chapter,we start from the relevant provisions of community banks, from the regulatory body, regulatory philosophy, regulatory approach these three aspects of regulation of community banks existing problems;The third chapter introduces the legal and regulatory system of America which is the origin state of community bank and also developed successfully,in order to draw some useful experience for our country;The fourth chapter we attempt to make recommendations on the feasibility of community banking supervision with the aforementioned analysis, in order to promote China’s banking community and its legal regulatory developments.
