Study On The Supervision Trustee System In The Antitrust Review Of Concentration Of Business Operators

With increasing number of cases of concentration of business operators in our country, the anti- monopoly examination put forward higher request to the implementation of the anti- monopoly law. It is inevitable that we further discuss on the conditional approval system of the concentration of business operators. The supervision trustee as a supporting measure is the guarantee of the smooth implementation of the restrictive conditions. In practice, the anti monopoly authorities in various countries pay more and more attention to the supervision trustee, and our country is no exception.This paper has four chapters altogether. The article respectively discusses the basic theory of the supervision trustee system, current situation and development trend of the trustee system in our country, the existing problems of the supervision trustee system in our country and suggestions on perfecting the system of supervision trustee system. Mainly through the following two parts of the description, the article highlights the theme that in addition to few cases, it is appropriate to appoint supervision trustee in most cases. We should make efforts to make the appointment of the supervision trustee tend to be normalized and standardized.The innovation of this paper lies in: in the research content, compared with the previous research results, there are new foci. First, in this paper, the responsibilities of the supervision trustee under different conditions are analyzed. Focus on the problem that is the responsibilities of the supervision trustee in the implementation of the behavioral condition,existing domestic research missed. Second, the manner in which the trustee is applied, the applicable scope and conditions of the supervision trustee as natural person, the comparison and application of the foreign supervision trustee and the domestic supervision trustee,and so on, these questions are rarely mentioned by scholars. This article tries to analyze and solve these problems with some ink. So as to put forward practical value in the research of the system of the supervision trustee.
