The Exploration Of Jurisdiction Constant Of Civil Action Of China

In recent years, the phenomenon of scrambling for jurisdiction is continual in the judicial practice because of the undefined jurisdiction. Therefore, there are three basic concepts to determine the jurisdiction of civil lawsuit system in China, objective, fair and efficiency, and our country has determined the system of civil litigation jurisdiction on the three basic theory. However, there are still some problems and defects civil litigation jurisdiction system in China, and the system of the jurisdiction constant is no exception. The paper attempts from a principle of the jurisdiction system---the principle of jurisdiction constant, combining with the problem of the legislation and practice of the jurisdiction, to build more systematic system of jurisdiction constant to contribute to improving the system of the jurisdiction slightly. Concretely, the paper starts with the general theory of jurisdiction constant of civil action, analyzing the legislation actuality and practice actuality of jurisdiction constant of civil action of China, rebuilding the system of jurisdiction reference time,perfecting the relevant laws and regulations, establishing applicable error relief mechanism. The author tries to establish jurisdiction constant of civil action of China by collecting data, analyzing problems, providing advice and combining with the basic idea of jurisdiction of civil action.
