From “The people’s court reformed the outline second 5 year” was promulgated in 2005,“number management” court evaluation become the key of implement “science” and “unity” which were proposed in “The people’s court reformed the outline second 5 year” by courts at all levels.But in practice,the tendency of “data-based” become a barrier to courts for improving social image and judicial public faith force.At the end of 2014,the People’s Supreme Court declared:abolish ranking system for courts at all levels completely,that policy makers are best understand the challenge of judicial reform and they have the determination to carrying on the reform.The tendency of “data-based” can be regarded as a error signal in “adverse selection”,so the present study have the expansion in two aspects:1.Investigating if “adverse selection” can be used in the study of judicial administration.We will study on causes and effects of “adverse selection”,compared with causes and effects of judicial administration.If they are agree with each other,we can say “adverse selection” can be used in the study of judicial administration.2.Studing the function and limit of court evaluation.3.Discussing economics correction of “adverse selection” enlightenment for the reform of court evaluation.Our reform of court evaluation can based on previous studies.The research framework cover three parts:In the first part,this paper introduces the basic concepts of court evaluation in production, development and significance.It talks about “adverse selection” in economics,pointing out that the prerequisite for “adverse selection”——“information asymmetry”and its consequence——“adulteration expels fine”.And this paper studies on “information asymmetry” and the game theory in court evaluation that “adverse selection” can be used in court evaluation.Showing the function and limit of court evaluation.The second part introduces the basic concepts of “adverse selection” in court evaluation at first.Then it studies on “adverse selection” in court evaluation based on empirical research.It chooses five data to be observation indexes,find that “adverse selection” in court evaluation have complexity and regularity.The causes of “adverse selection” cover four parts:the tendency of “data-based”,signal distortion,the dislocation of the signal sending subject,the closed process of signal sending.The effects of “adverse selection” cover two parts:direct effects and indirect effects.The third part studies on corrections of “adverse selection” in court evaluation from system and technique,which based on “separating equilibrium” and “signaling”.
