Study On Administration Of Safety Of Jails And Other Places Of Custody In Public Security Organs In China

Jails and other places of custody in public security organs are criminal and administrative law enforcement organs of the nation which are established in accordance with the laws. The Administration of safety of jails and other places of custody in public security organs is the core task of administration of those places. Study on administration of safety of jails and other places of custody in public security organs has a very important significance to the insurance of safety and stability of jails and other places of custody in public security organs, to the prevention and decrease of illegal activities and the crimes, to the improvement of administration of those places and to the promotion of construction of the harmonious society. Taking administration of safety of jails and other places of custody in public security organs to be study object and the administration of safety of detention houses in public security organs to be a breakthrough point, this article has depicted the actual condition and analyzed present problems of administration of safety of jails and other places of custody in public security organs in China and the causes. On these bases, this article advances a general thought and specific measures of strengthening administration of safety of those places. This article has four chapters.Chapter One advances thought and methods of study of this article through the summary of administration of safety of jails and other places of custody in public security organs, significance of studying administration of safety of those places and comparison of domestic and overseas situation and opinions of study.Chapter Two has introduced the overall conditions of administration of safety of jails and other places of custody in public security organs and has analyzed the subjective and objective factors which influence the administration of safety of jails and other places of custody in public security organs with a depiction of overall conditions as well. It points out that these factors have influenced the safety and stability of jails and other places of custody in public security organs. The subjective factors are as follows: the guiding ideology of administration of safety of jails and other places of custody in public security organs is one-sided; a part of policemen of those places have vague idea of administration of safety; policemen of those places are listless at their job; the concept of law enforcement of policemen lags behind and the like. The objective factors are as follows: the present ensuring mechanism of jails and other places of custody in public security organs in actual work is not strong yet; the police force in those places is lacking seriously; the infrastructure of some places of custody are comparative under-developed; the number of people held in custody has been growing rapidly; the extent of subjective culpability of the mind of criminal cases is increasing and the like.Chapter Three introduces the experience of prison administration of U.S.A, Britain, Germany and Spain and points out it crucially important to develop the mode of separate detention and separate administration, to improve the construction of jails and other places of custody in public security organs and to carry out the hierarchical and systematic administration of policemen.To resolve present major problems, Chapter Four advances both a general thought and specific measures of strengthening the administration of safety of jails and other places of custody in public security organs in China on the basis of using the experience of foreign countries for reference. The first measures is to enhance the guarantee system for administrative work in jails and other places of custody in public security organs both in legislation and outlay by defining the source of the outlay and defining the guarantee standard of the outlay scientifically and strengthening the supervision of the use and administration of the outlay. The second one is to enhance the quality of specialization of construction of infrastructure in jails and other places of custody in public security organs by constituting a standard of constructing of infrastructure of those places and establishing an evaluation mechanism of construction of infrastructure of those places and attaching importance to specialized administration of the course of construction of infrastructure of them. The third one is to establish an standardized operation mechanism of jails and other places of custody in public security organs and improve the administration of safety of those places and promote the identification and elimination of hidden perils and attach importance to the validity and pertinences of the affixing responsibilities. The fourth one is to establish a system of crisis management in jails and other places of custody in public security organs and improve the process of disposition of crisis and increase the speed of response to crisis and pay attention to the orientation of public opinion. The last measure is to strengthen the competence of policemen of jails and other places of custody in public security organs, set up an access qualification of the policemen in those places, establish a system of communication among various police categories in public security system and system of classifying the staffs working in those places, strengthen the capacity building of the policemen of those places.
