Based on the foundation of legal’s characteristics such as validity, executable, stability, my paper studies the public institutions’ pension insurance legal system in juristic view will provide theoretical guidance to constraint and finalize the public institutions’pension insurance legal system.First of all, this paper explores the current situation and problems related to the public institutions’ pension insurance legal system. Secondly, through comparativing with few developed countries relevant provisions, combining with transformation and reform of the public institutions’pension insurance legal system, summarize legislation revelations on this basis. Finally, analyzes the necessity and significance to promote legislation. Most of all, proposes legislation improvement recommendations that building a public institutions’pension insurance legal system meet our country’s current conditions. Public institutions’ pension insurance need the guide of law, need to be protected implementing through legislation. Only improve the basic legal theory, clear the basic concept of legislation, clear legislative subject organs, improve the legislative level, select reasonable legislative system, enrich the merger plan, consummate legislative content, can complete the build of public institutions’pension insurance legal system step by step, can develop a strong operational public institutions’pension insurance law, and implement solidly.
