The Study On Legal Issues About Rural Medical Insurance System In China

While the urban areas are developing rapidly, peasants still account for a large proportion in population in our country. Quite a large number of peasants who have long been working and living in the city still have remained the status of peasant. Because China is a large agriculture country, land and its attached rights and interests are the most fundamental guarantee for peasants. Therefore, effectively solving various kind of problems in peasants’ life is the premise of our country’s economic development, which is also vital important in the process of development and modernization construction of socialism with Chinese characteristic. Agriculture insurance is the most important guarantee of rural social and economic development. "Agricultural Support and Protection system" is proposed in Chapter 21 of the 13th Five-year plan sketch designed by Central Committee of Communist Party of China, highlighting that our Party attaches great importance to improving rural medical insurance system.With the development of urban-city integration, many problems occurred in the process of implementing rural medical insurance legal system, such as legislative level is low; overall funds are not sufficient; government’s supervision is not effective etc.. To improve our country rural medical insurance system and equitable distribution of medical resources, it is necessary to analyze the practical problems to break through legal barriers, ensure financing mechanism, boost commercial medical insurance and strength supervising system with the purpose of promoting the innovation of our rural medical insurance system as well as the healthy development of rural social insurance business.The paper first gives an overview of our country’s rural medical insurance system on the basis of related concepts and theories, and then introduces its several stages from beginning, development, declining, disintegration to restoration and re-development. Next, the paper makes a further survey and analysis on the current situation of our country’s rural medical insurance and legal issues in agriculture insurance system. Besides, the paper also studies and analyzes other country’s rural medical insurance system, such as America, Canada and Japan to find some worthwhile methods to perfect ours. Lastly, the paper gives some advice and practical strategies on perfecting our country’s rural medical insurance system.The significance of this paper is to find out the problems in the process of practicing the system through the legal analysis of our country’s rural medical insurance system and improve it by means of perfecting our legal system and supporting mechanism.
