As an important part of the social security system, insurance health plays a huge role in the protection of citizen’s health and maintaining social stability. With the continuous development of medical insurance system in our country, especially after the enforcement of "social insurance law" in July 2011, the implementation of the medical insurance system has got rapid development and progress; the safeguard scope has expanded unceasingly; the safeguard level has improved gradually, which preliminary solved the medical security problem for 1.3 billion people.Anyway, the provided medical insurance system of "social insurance law" of our country is divided into 3 systems for urban occupation, urban residents and the new rural cooperative medical system in accordance with the citizenship. Citizens participate in different medical insurances in accordance with different household registrations and occupations, while there is a big gap in financing, management, treatment standard for the three kinds of health care, which makes citizens of our country may be treated with discriminatory and discriminating treatment of health care due to the difference of the household registration or occupation. This kind of health care system seriously violates of the equality principle of the constitution, and the equal rights of health care treatment of citizens.This article analyzed the current legislation and medical insurance system in China at first, summing up the characteristics of the current health care legislation in China. Although "social insurance law" made basic provisions, the administrative rules and local government regulations are mainly taken as the normative documents in the implementation of the medical insurance system, resulting in the characteristics of variable policy, obvious regional differences for medical insurance system legislation in our country, which is not conducive to the long-term stable development of health care system.Secondly, this paper introduced the implementation of medical insurance systemin L County combining data for L County in the north of Jiangsu Province. L County is a predominantly agricultural county. At present, three kinds of medical insurance system are widely covered and implemented in the county. This section introduced the present situation of health system implementation in L County in aspects of the agency management, requesting of being involved in insurances, funding level and the treatment. But in recent years, along with the liquidity of the urban and rural residents increased, the defects of divided medical insurance system are also highlighted,Besides, on the basis of L county health system implementation, this paper concluded common problems such as the infringement of citizens’ equal rights, repeated involvement of insurances, the waste of management resources, and fund security risk in the current medical insurance system. Along with the development of economy and urbanization, the identity boundaries between among rural residents, urban residents and urban workers increasingly weakened. The medical insurance systems distinguished basing on the three identities also meet a real dilemma.Finally, proceed from equal citizen rights, this paper provided suggestions on the reform of medical insurance system in our country refer to the experience of the medical insurance system in Taiwan of China and Germany. First, we need to improve the current legislation of medical insurance in our country, establish a unified legal system, and avoid the unequal health treatment caused identity differences. Secondly, refer to the current reality, it is recommended that the development of health care system reform in our country should be divided into two steps in the future. Preliminary goal is the combination of urban and rural residents’ medical insurance system, for which the reason is that these two forms of insurance are very similar in both the legal nature and management mode. So the combination is easier for maintain and implement. The ultimate goal of China’s health care system should be a combination of town worker, urban and rural residents, achieving the unification of the whole medical insurance system, constructing the medical insurance system in our country into a system with perfect coverage, welfare unified justice, and more stable development.
