The Research Of The Integrated Use Of Soft Law And Hard Law In The Field Of Customs Law Enforcement

Since the1970s, the concept of hard and soft law is gradually recognized by the lawexperts of our nation. What’s more, the concept of hard and soft law is also used inthe field of law enforcement by the administrative organs. As a national regulatoryauthority, customs responsible for the management of import and export ordermandate and promote the import and export facilitation services responsibilities. So inthe enforcement of the customs administration, in addition to a range of traditionalhard law, soft laws such as rules, procedures and mechanisms are also useful. Thecustoms of Tianjin as a part of Chinese customs, facing the situation of toughenvironment for the port and special regional economic, has to transform itsgovernment functions.Chapter1describes the background of the topic and the Domestic and foreignresearch literature on soft and hard law. Chapter2and chapter3describe thetheoretical basis and the application of international customs law enforcement of thesoft and hard law. By analyzing the basic theory and the advanced experience offoreign customs, it helps to comprehend the necessity and importance of theintegrated use of soft law and hard law. To Customs of Tianjin as the object of study,Chapter4describes and analyzes a lot of enforcement issues of using the soft law andthe hard law to solve legal problems. It also introduces the cause of the problemseparately from the human factors, institutional factors and environmental factors inChapter5.The last chapter is the summer and the expectation of this paper. It gives theconclusion that the customs of Tianjin need to combine the advantages of the soft lawand hard law, try to find the way of the integrated use of the soft law and hard law toachieve the goals of the effective governance of import and export market in Tianjin.It also put forward the views that it should take measures in terms of the macroaspects, micro aspects and environmental aspects.
