Research On PPP Contract System

PPP project contract system is a kind of relational contract collection based on aseries of cooperative partnership. The PPP project involving the whole constructionprocess of financing, construction, operation, management and transfer etc., ithas long cooperation period, huge capital investment, many interests participated in anduncertain environment for cooperation, which forms the complex relations ofcooperation. Due to the particularity of PPP project、integrity of contract system andcritical of contracts subject, based on the analysis of the related concepts and theories,this paper firstly explored the particularity of PPP projects through the operatingmechanism，its whole life cycle and the relations among the stakeholders. Secondly itgets the research route by drawing lessons from contract systems of domesticengineering projects, international engineering projects, Australia’s and Hong Kong’sPPP projects. Then it analyzes the typical patterns under the PPP mode. Finallyit carries on the classification of all the PPP contracts from the stages, contents,parties and nature.And by analysising the contractual relationship between the variousPPP projects contracts,builds up PPP projects’ contract system in our country from theangle of their necessity and importance, taking the example of the specific PPP modelwhich is most suitable for China’s national conditions and used in actual projects.Theconclusions are as follows:first of all, the key factors of the differences among PPPprojects’ contract system is the specific mode. Second, the PPP project contract systemis an adaptable menu type of contract documents which compose of a series ofdocuments. According to the PPP contract documents’ classification from the angle oftheir necessity and importance; it can build up the PPP contract system. It is consistedof the necessary contracts, the core optional contracts, mainly optional contracts, thesecond choice alternative of the contract. And combine two-dimensional perspective ofthe various stages of the life cycle and the importance of the contract, classify andorganize the optional PPP contracts system.
