The Study On The Policy Instruments Selection In Protection Of Intellectual Property Rights Of China

The study on policy instrument with public policy is getting more and more attention from our domestic experts. As the bridge between the policy objective and policy result, policy instrument is very important for achieving the policy result. With the coming of era of knowledge economy, the intellectual property right (IPR) has become the focus at home and abroad. The protection of IPR can be divided into three stages in our country, namely the seed period, exploration period and self-promotion period. We must admit that our government has made the great effort to protect IPR; however, the current situation of protection of IPR is still not satisfied, which mainly embodies the fake products still are stuffing the market, the IPR protection awareness of our resident is still very poor, and the innovation ability of enterprises is not very strong. So, it is not enough to just make policy for IPR protection, more attention should be paid from the view of policy instruments. By sorting out the policy instrument during the three stages of protection of IPR, it can be found that the implementation of compulsory instrument, the mixed instrument and volunteer instrument have been promoted to some extent and produce a very positive effect for IPR. However, affected by policy objective, policy instruments itself, market mechanism, and awareness of resident, the policy instrument does not realize the expected effect. So, for this problem, the paper wants to analyze from the view of policy instrument, and combining with the situation of IPR protection at same time. Through analyzing the effect of policy instruments and effective of three policy instruments by the method of grey relational analysis, it can be read that the effective of compulsory instrument has obvious advantage to realize the policy result, and the rests are inferior to the compulsory instrument. To make full use of advantages of three policy instruments, the paper wants to analyze from the layer of policy instruments so as to give the reasonable advice through clearing the influence factors, constructing the transparent procedure and building up the scientific evaluation method and so on.
