Along with the improvement of education level and the change of consumption concept, Chinese residents act the real estate market gradually as a basic tool for investment. In order to stimulate our residents’housing demand, and then bring the growing domestic demand, commercial Banks in China began to comprehensively promote the development of this business from the residential mortgage lending business pilot, these strong policy measures have brought the abnormal prosperity of real estate market in China, the real estate’s contribution to economy has gradually improved, But the risk of the real estate market has been neglected.The sub-prime mortgage crisis in2007has sounded a warning to the people, it is the U.S. housing market bubble burst triggered the sub-prime crisis and thus brought the grave disasters to the U.S. financial system and the world economy. The real estate market has its own capacity, when the housing bubble continue to be magnified, its potential risks are constantly accumulating. Once the high house prices are unsustainable, real estate bubble will burst. Due to the financial participation is higher, the real estate market is bound to have a severe disaster to the financial system, which will be spread to the real economy and interfere the healthy running of the economy running.Since the time of our mortgage business still relatively short compared to the developed countries in the mortgage business, the accumulation of experience in the mortgage business is not enough, coupled with our current economic and financial legislation is not perfect, which gave birth to the soil of "fake mortgage".At present, with the constant development of the real estate market, the proportion of "false mortgage" is also rising. If let this kind of phenomenon continue to develop, China’s financial system is bound to subject to a serious impact, thereby the healthy development of China’s economy will be affected. Therefore, in order to avoid the happening of this kind of situation, the study of "false mortgage" is especially urgent and necessary. Based on this, the paper tries to analyze the causes of "fake mortgage" research, combined with case specific analyzing the manifestation and characteristics of "fake mortgage",finally, combining with the relevant research results and the actual situation of our country, and then puts forward some Suggestions to prevent the harm.
