The Research Of Government Action On Protection The Interests Of Farmers In The Process Of Land Acquisition And Resettlement

With the acceleration propulsion of China’s urbanization, the numbers of landless peasants in China are getting bigger. As a result of the process of social development, landless peasants are increasingly becoming an important groups. To protect the interests of farmers in the process of land acquisition, resettlement is used instead. Government is the main promoters and implementers in the land acquisition and resettlement. Government behavior plays a vital role in the protection of farmer’s interests. Government behavior is generated by fulfilling certain functions. Fulfilling political functions, economic functions, cultural functions and social functions, the government can impose different impact on protection of the interests of farmers in the process of land acquisition and resettlement. In the process of land acquisition and resettlement, the government will effectively protect the interests of farmers through scientific and humane land acquisition and relocation manner. Promoting land acquisition and demolition will be carried out smoothly. Otherwise, it will bring damage to the interests of the landless farmers and even endanger social stability. In this paper, by analyzing and exploring the government action in the land acquisition and demolition process the protection of the interests of the farmers whose land is requisitioned will be promoted.This paper selects Qianwei, a city in Sichuan Leshan, to study the behavior of the local government in building a new town process of land acquisition and resettlement.The paper summarizes the policy, program and the special working group mechanism of land acquisition and resettlement and landless farmers’ social security system, the transfer of employment of the landless farmers, landless farmers and political rights protection. By surveying the local farmers’ satisfaction, our analysis shows us that there are many intrinsic factors that significantly affect landless farmers’satisfaction. This survey serves as a practical reference of this study. This paper is divided into three main parts. The first part is about raising the issues which is mentioned in Chapter One and Chapter Two. To sort out the related concepts of land acquisition and landless farmers interests, we summarized the concept of "government action", limited the meanings of land acquisition. According to the actual situation and the interests of farmers of the land acquisition and resettlement we will put forward the interests and needs of the landless farmers in systematically, including landless farmers demand for political interests, economic interests and cultural interests. To sort out the theoretical basis of this study, the rent theory mainly include the theory of limited government, social security theory and so on, as a theoretical preparation for analysis.The second part of this thesis focuses on analyzing problems. This is Included in Chapter Three and Chapter Four. It is the principal focus of this study. It aims at analyzing the government action on protection of the interests of farmers in the process of land acquisition and resettlement. First and foremost, the performance and its consequences of the farmers’interest loss in land acquisition and resettlement process will be briefly explained. Secondly, we will also briefly discuss the policies, laws and regulations for the protection of the interests of farmers on the land acquisition and resettlement process. Finally, government behavior problems on loss of farmers’ interests will be analyzed. It mainly specifies that the policy negative effects, program anomic, compensation standards are not uniform. The Government’s interests have a tendency to be selfish. Government style is not practical, government supervision is insufficient and there is sometimes the lack of government services function.The third part is about problem-solving. It is mentioned in Chapter Five and Chapter Six. In the second part, we mentioned about the protection of the interests of the landless peasants which should not be unilateral. Its measures should not be mutually split or run independently. It needs the government to develop effective strategies to solve the problem in many ways. Furthermore it also specifies the analysis of the landless farmers’satisfaction survey by using the reliability analysis, validity analysis, factor analysis, and analysis of variance. From the government action experience of Qianwei in the process of land acquisition and resettlement, we propose some measures of government action for the protection of the interests of farmers in the process of land acquisition and resettlement systematically.
