In the background of the rapid development and widely used of global GM technologyin the field of agriculture, the commercialization process of genetically modified organismstechnology and the protection of intellectual property rights are becoming more and moreaccelerating. Transgenic biotechnology, as a new technology revolution, has been changingand influencing on human life. It brings huge benefits and unpredictability results to humansociety at the same time, and it has never stopped people’s research on it. In our China, wetreat modern biological technology as a national priority technology to invest and develop,and we have made the corresponding patent achievements. During the research program, itwill involve the researchers’ behaviors of researching when using technologies and patentscoming from others. These will affect the independent research, development of intellectualproperty rights and the efficiency of GM technology investment, and may cause possiblepatent infringement dispute in the late stage of commercialization.This paper is based on the questionnaire investigation of team leaders coming from200institutions which participate in GM technology research. It firstly describe the currentsituation of the development of transgenic technology and the intellectual property, andthen use questionnaire data and the Probit Model to analysis the behaviors of researchers tofind whether they choose to take patent avoidance behavior or not when using others’technologies or patents and what are the reasons. Then, the thesis will analyze whether theywill sign an agreement if they don’t take patent avoidant behavior. At the end, it will putforward some strategies and policy recommendations on efficiently using the technology todo research, such as, strengthening the consciousness of scientific researchers on protectingof intellectual property rights, improving the transgenic biotechnology protection system,the research ability and the efficiency of intellectual property rights. |
