Competitive Intelligence And The Research For Intellectual Property Disputes And Litigation

Intellectual property rights as a new means of trade restrictions, the protection based on the concept of innovation, has been paid attention to by more and more countries. The process of China’s enterprises in the overseas market, often encounter the intellectual property disputes and lawsuits of intellectual property rights, the overall situation is very serious, especially with countries in the protection of intellectual property rights to further improve the legal system, and the development of economic globalization, intellectual property disputes and litigation in China’s enterprises are facing in the international competition in the present frequent trend. How to avoid the infringement dispute resolution and will become an important research topic in the modern enterprise competitive intelligence.However, the research on enterprise competitive intelligence is mainly concentrated in the aspects of the protection of intellectual property rights, competitive intelligence research in intellectual property disputes and litigation is not enough, so this paper based on the general research on the competitive intelligence and competitive intelligence system for intellectual property disputes and litigation are studied, the main work is given as follows:First of all, this article from the basic process of competitive intelligence, competitive intelligence function, in the face of intellectual property disputes the need of enterprise competitive intelligence in support of the three perspectives to analyze the role of competitive intelligence in international intellectual property disputes and litigation. Secondly, through the analysis of case study of intellectual property in dealing with intellectual property disputes and lawsuits in how to make use of competitive intelligence to achieve early warning, the competition of intellectual property rights of environmental monitoring, tracking analysis and competitors to help enterprises to establish the respondent union early. Finally, combining with the competitive intelligence in enterprise intellectual property disputes and litigation in the role of a competitive intelligence system to deal with intellectual property disputes and litigation, improve enterprise capability of decision support, help enterprises to avoid risks and improve business disputes in the litigation responding ability.
